Welcome to FlynCar! These Terms and Conditions ("Terms") govern the use of the FlynCar platform ("App") and set forth the legal relationship between car renters ("Owners") and customers ("Renters") using our platform. By using the App, you agree to these Terms.

  1. General Use

    1. All users must be at least 18 years old to create an account and use the FlynCar platform.

    2. By using the App, you agree to provide accurate information and promptly update any changes to keep it accurate.

    3. The owner can request a different age limit and may require a minimum driving license seniority.

  2. Reservation and Payment

    1. Reservations are made through the FlynCar App. Full payment is required when the owner agrees to confirm the reservation. We accept major credit cards and debit cards.

    2. The Renter is responsible for all tolls, parking, and traffic violations incurred during the rental period.

  3. Rental Period

    1. The rental period is defined in the reservation details. Late returns may incur additional charges. Early returns will not result in a refund.

  4. Vehicle Use

    1. The vehicle must be used in a safe and responsible manner. It may not be used for any illegal purposes, off-roading, racing, towing, etc.

    2. The renter agrees not to allow anyone to drive the vehicle other than the drivers listed and approved on the reservation.

  5. Listing a Vehicle

    1. Owners are responsible for accurately listing vehicle details, including its condition, features, availability, price, and guidelines.

    2. Owners must possess legal rights to rent the vehicle. FlynCar is not liable for any misrepresentation in this regard.

    3. Owners are obligated to maintain their vehicles in safe, operational, and clean conditions.

  6. Vehicle Inspection

    1. It is essential for the owner to conduct both a check-in and check-out procedure with the renter. During these inspections, the owner must capture comprehensive photographic evidence of the vehicle's condition, both externally and internally. This ensures an accurate representation of the vehicle's state.

    2. In the event that the owner wishes to report damage, it is crucial that the discrepancies in the vehicle's condition are clearly evident in the comparison of the check-in and check-out photos. Absence of such proof means the renters cannot be held responsible for any damages.

  7. Damage

    1. The renter is responsible for any damage to the vehicle during the rental period, regardless of fault. This includes but is not limited to theft, vandalism, collision, and weather-related damage.

    2. The renter must return the vehicle in the same condition as it was rented, except for normal wear and tear. Any required maintenance or issues with the vehicle should be reported to the Owner immediately.

    3. In the event of damage, the renter should contact immediately the Owner without moving the vehicle. The owner will give to the renter the step to follow.

  8. Relationship of Parties

    1. The rental agreement is solely between the Owners and the Renters. FlynCar serves only as a platform to facilitate these transactions and does not, in any way, act as a representative, agent, or insurer for either the Owners or Renters.

    2. FlynCar cannot be held responsible or liable for any agreements, disputes, damages, or any other issues that arise between Owners and Renters. Both parties acknowledge and agree that they are entirely responsible for the nature and execution of their agreement.

  9. Insurance

    1. The renter agree to insurance terms and condition provided by Owner, all coverage condition can be review on the reservation, and at payment wall.

    2. The renter is responsible for the deductible amount in the event of a covered loss.

  10. Liability

    1. FlynCar acts as a platform connecting Owners and Renters and is not liable for any direct or indirect damages, incidents, or disputes arising from rentals.

    2. FlynCar is not responsible for any personal property left in the vehicle or any injuries sustained by the renter or passengers.

    3. Owners and Renters agree to indemnify FlynCar against any claims, damages, losses, or legal fees resulting from their use of the App.

  11. Cancellation Policy

    1. Please refer to Cancellation Policy

  12. Dispute Resolution:

    1. Owners should report any additional cost through the FlynCar App within 24 hours of the check-out time.

    2. Disputes should first be addressed between the Owner and Renter. If no resolution is reached, FlynCar may intervene at its discretion.

  13. Governing Law:

    1. These terms and conditions shall be governed by and construed in accordance with the laws of the state in which the rental takes place.

    2. The Owners and Renters must comply with the legal requirements of the state in which the vehicle is rented.

  14. Amendments:

    1. FlynCar reserves the right to update or amend these terms and conditions at any time.
